I must be in a Styx mood today.  I was awake at 3am this morning, with the song “Grand Illusion” by Styx ringing through my brain, which apparently does not need sleep as much as I do.  Actually, Styx has some fantastic lyrics in their songs and I believe like Michael, they saw that control of what we see, hear and perceive needs to be reclaimed.

I copied some text from some of the news pages who were trying to cover the events of the first preliminary hearing yesterday, of Conrad Murray.  This is so that those of you who have yet to find it can read it.  For personal reference though, I copied them and read them to get a good laugh because very few of them have been able to keep a consistent story of what actually happened in the court room.  The basics are the same, but details are all over the place.

Faheem Muhammad, one of Michael Jackson's bodyguards, just testified he was in Michael's room after Murray noticed MJ stopped breathing. Faheem told the prosecutor, Murray was on his knees doing compressions on MJ in a panicked state, when he turned to Faheem and another bodyguard and asked, "Does anyone in the room know CPR?"

Faheem recalled how Prince and Paris were near the room and Paris was on her hands and knees crying.  The nanny took them away.

Faheem also said after Michael was pronounced dead at UCLA, Dr. Murray told him he was hungry and wanted to leave. Faheem said he told Murray to eat at the hospital, but Murray left.

On cross-examination, Ed Chernoff got Faheem to admit Murray spoke with MJ's family and police before leaving.

The prosecution began to paint a picture of Dr. Conrad Murray's reckless actions on the night MJ passed away ... by calling to the stand the Jackson assistant Murray telephoned before he called 911.

Michael Amir Williams testified that he received a frantic voicemail from Murray at 12:13 PM on June 25, 2009. Williams said Murray's VM said, "Where are you? Get here right away, hurry."

Williams says he then called Alberto Alvarez, MJ's security guard, and asked Alvarez to walk to the front door. Williams says he heard Murray's voice in the background, then Alvarez hung up.

Williams said that later on at the hospital, Murray approached him and said Michael had some cream in his room that Murray knew MJ wouldn't want the world to know about. Williams said he wanted someone to give him a ride back to MJ's house to retrieve it.

Murray's baby mama, Nicole Alvarez, was in court today -- but ordered to return on Friday. Murray was on the phone with Alvarez when he realized MJ was in trouble.

Kenny Ortega, MJ's producer/director for "This Is It," was the first to testify, stating just days before MJ died, Dr. Murray was upset that Kenny sent MJ home from rehearsal on June 19.  According to Ortega ... Murray felt only he should make such decisions.

According to Ortega ... Dr. Murray said during the June 20 meeting at MJ's home that Michael was "physically and emotionally fine," even though Ortega said MJ had the chills and was not well during the failed rehearsal the day before.

The June 20 meeting at MJ's home is important for prosecutors, who claim it shows Murray did not care about MJ's health.

And Ortega said June 23 and 24 were "two wonderful days of rehearsal" and that MJ was happy and healthy.  The point -- that Jackson wasn't in distress the day before he died, and it was the Propofol that did him in.

Ortega testified, "He didn't look well at all. Michael was chilled and soft-spoken ... He wasn't in the kind of condition to be at rehearsal."

During cross examination, Ortega denied he read Michael "the riot act" during the June 20 meeting.

David Walgren - Los Angeles County Prosecutor David Walgren began to lay out the case against Dr. Conrad Murray ... saying in his opening statement that Michael Jackson was dead even before paramedics got to MJ's home.

Walgren also told Judge Michael Pastor Murray tried to conceal the fact he had administered Propofol to Jackson -- categorizing Murray's actions as and "extreme deviation from the standard of care."

Walgren said the evidence will show Murray ordered a bodyguard to help him clean up evidence and waited at least 20 minutes before he called 911. Once Jackson was taken to the hospital, Walgren said Murray still had not told anyone about the use of Propofol, saying, "Not a word was said about Propofol to the UCLA doctors."

He also pointed out Murray performed CPR incorrectly -- with one hand on his bed, rather than a hard surface.

Murray's attorney, Ed Chernoff, declined to make an opening statement.

TMZ had a surprisingly dry and un-detailed report on yesterday’s proceedings.  This was more of an outline of the highlights of testimony in the pre-trial.

Fox News looked like disjointed note taking that they never bothered to clean up before submitting.  Does an editor work there?  I know it’s the blog but doggone!  There was a bit more detail  to this one if you can get past the language barrier.  Did you catch the mention of the illusion?  Several forums and news sources included this in Ortega’s testimony.  I only included Fox News version to save room.

The prosecution has been presenting details of Michael Jackson's death and they claim Dr Conrad Murray waited up to 20 minutes before phoning paramedics for help.

The BBC's Rajesh Mirchandani says prosecutors allege Dr Murray's negligence while treating the singer for insomnia led to his death aged 50 in June 2009.
Conrad Murray's lawyers say he did not give Michael Jackson anything that would have killed him.

BBC did not have hardly any detail, at least in writing.  I thought it amusing that Jackie Jackson was mistaken for Jesse Jackson, whom I guess they assume is a family member just because they have the same last name.

NEW YORK (CBS) The death of Michael Jackson last June 25 spurred an onslaught of news coverage, a very public memorial and a blockbuster documentary on the preparations for his comeback tour. It also brought on legal investigations into the circumstances surrounding his death.

Here's where the investigations and criminal proceedings stand now, exactly one year later.
By August, the King of Pop's death was officially ruled a homicide, caused by acute intoxication of the powerful anesthetic propofol with other sedatives as a contributing factor.

Six months later, on Feb. 8, 2010, Jackson's personal physician, Dr. Conrad Murray, was charged with involuntary manslaughter by prosecutors in Los Angeles. Murray pleaded not guilty, was released on $75,000 bail and is currently awaiting trail. He maintains that nothing he gave Jackson should have killed him.

CBS News legal analyst Trent Copeland said that Murray can be expected to launch a "very aggressive" defense to the charges against him.

"Any plea to a felony conviction would disqualify Dr. Murray from ever practicing medicine again - anywhere," Copeland said. "From his perspective, he is a healthy, relatively young physician with many years left to practice and make a living and his right to continue to do that would be devastated by losing this case."

With that in mind, Copeland adds there is "virtually no possibility" of settling the case through a plea bargain.

Copeland said to expect that the defense would argue that while it is uncommon for a physician to prescribe and administer propofol outside of a hospital setting, it is not, however, negligent per se to prescribe it in the small doses that Murray admits to having given to Jackson. This, along with allegations that Jackson's complicated pharmaceutical history and over-reliance on medications that Murray wasn't even aware the singer was taking, will make up "the core" of the doctor's defense.

Jackson's lifestyle and reliance on drugs, combined with allegations of "doctor shopping," will also play a part in the trial.

"Indeed, putting Jackson on trial from the grave will be the essence of the defense case," Copeland said.

Joe Jackson's complaint against AEG, in which he alleges the promoter of his son's upcoming tour of engaging in the "unlawful practice of corporate medicine" and forcing Murray to provide Jackson with dangerous medical services, may also aid in Murray's defense.

"The case clearly focuses on the efforts that Dr. Murray was taking to provide a safe medial environment for Jackson and AEG's unwillingness to financially foot the bill," Copeland said. "This may make Dr. Murray a more sympathetic defendant to the jury and he must hope that whatever information is learned in that lawsuit against AEG can be used in his trial. Having those two parties fighting each other can only take some of the spotlight off of Dr. Murray's conduct."

As for the prosecutors, Copeland said that the aggressive way they have gone after Dr. Murray's license to practice medicine in California strongly suggests that the district attorney's office "will stop at nothing to get a conviction" in this case. (A judge declined a request by state authorities to suspend the doctor's license on June 14.)

By charging Murray with involuntary manslaughter as opposed to second degree murder, Copeland explains, prosecutors went for the "low-hanging fruit." Losing on the perceived easier counts would be a blow in the court of public opinion. He does not expect a deal to be offered to the doctor.

Michael Jackson's family - from his mother and father to his famous brothers and sisters - has been a strong and vocal presence throughout Murray's legal proceedings, and will probably be front and center in the courtroom if and when his case goes to trial.

Copeland said their presence will affect the jury - to an extent. But the longer the trial goes on, the more their effect will diminish.

"After some weeks they simply become part of the gallery and the jurors may even forget that they are there," he said.

Jurors becoming accustomed to the family's presence would be the best-case scenario for the defense, Copeland explained. The prosecution, however, will welcome their presence as a reminder to the jury of their loss.

The singer's family members aren't the only ones watching over the proceedings: Jackson fans around the world have also followed news of the icon's death and the subsequent investigations throughout the past year, and will continue to do so when the case goes to trial.

"Clearly, even from the grave, Michael Jackson commands attention," Copeland said. "His persona and presence in the courtroom will hang over the entire proceeding."  Source CBS News

Wow!  What a way to come out of the gate, CBS!  The narrative was impressive until after the introduction to Trent Copeland. Then detail turned to sensationalism and a reliance on past headlines and rumors to juicy up the story a bit.  Mr. Copeland tried to edge in the assumption that Michael is a drug addict with a built up immunity to certain drugs with this statement:

“…Jackson's complicated pharmaceutical history and over-reliance on medications…”  and “over-reliance on medications that Murray wasn't even aware the singer was taking” completely DISREGARDS the EVIDENCE in the autopsy report.  Michael was on no other drugs aside from what Murray gave him.  There is also an assumption made BY A MEMBER OF THE PRESS that Michael hid other medications from Murray. This is a prime example of the criminal acts of the press to insert evidence and testimony that did not exist.

Copeland again in the very next paragraph states “Jackson's lifestyle and reliance on drugs, combined with allegations of "doctor shopping," will also play a part in the trial.

Then get a load of this from CBS:

“As for the prosecutors, Copeland said that the aggressive way they have gone after Dr. Murray's license to practice medicine in California strongly suggests that the district attorney's office "will stop at nothing to get a conviction" in this case.

If this doesn’t sound like a borrowed line from Tom Meserau in the 2005 case against Michael, I guess it is true what they say . . . imitated, never duplicated.  These people are so short on imagination, they can’t even create their own opinion, LOL!

CBS gets the star in lying today.

This is going to get better (worse?) before this is over.  And now for an explanation of the title of this blog.

Yesterday I heard of the testimony of Ortega including a discussion with Michael the day before he “died” on practicing an “illusion” the next day (the 25th of June, 2009) during rehearsals on the 24th.

That woke me up at 3am with Styx’s song “Grand Illusion” in my head.  I had to get up and write it down. Then I had to pull up the song on Youtube.  Then I had to find the lyrics. Then I found a video WITH the lyrics.   I knew the lyrics before but never REALLY listened  to them until now.

  1. Well, Kenny Ortega (initially called as a defendant in the AEG's case) now exposes his truth: again, I believe him. So a "Dr." C. Murray feeling "empowered" by AEG to scold K. Ortega on his past intervention to send Michael's home on June 19, 2009 when he felt ill & "dominate" Michael's life when not even capable (or not willing?) to save his patient's life, it is plain..disgusting.

    If it is true that Michael called Cherylin Lee in Atlanta around the Fathers Day or 19-20 June 2009, it shows how much he trusted his personal doctor, C. Murray ! he should normally have told his doctor or just go immediately to the hospital for a control. Whatever C. Lee's agenda was, what matters is, Michael did not tell his doctor he felt bad & it proves he was scared about the financial/legal measures Randy Phillips of AEG (who threatened & scolded him at his Holmby home on June 20, 2009) might have taken against him & he desperately needed at that time to make money for him & the MJ3.

    The work's contract AEG/C. Murray not even countersigned by Michael before his death ? strange ! some matter of contempt form C. Murray against Michael ?

    My Deepest Respects to Mr. Tom Mesereau who continues through the press to defend Michael Jackson. God Bless You, Mr. Mesereau.

  2. @LineCH - Who is Cherylin Lee? She along with June Gatling are among the people I seriously doubt will even be called as witnesses . . . because they were not.

    We are ASSUMING much of the past press on this is true. Who said Phillips scolded Michael?

    The AEG contract was ALSO not signed by AEG . . . Only Murray's signature was signed and this mysterious "contract" was left on the bed, as Michael sleeps with his contracts.

    Line, your use of "his" truth is starting to bother me . . . I've seen this before. There is no "his" or "hers" . . . only "The truth".

  3. Bonnie - you asked LineCH "who is Cherilyn Lee?"

    Cherilynn Lee is the nurse who went on Larry King Live and every other news show that would have her in the days after Michael died saying he had asked her to get propofol for him months PRIOR to his death. Of course she should be called as a witness; she wanted her 15 minutes of fame and got it. The LAPD detective's affidavit for search warrant lists her contacts with Michael as several times between January 2009 when she met him, and Father's Day 2009, when she herself said (again on every newscast that would have her) she got a call from Michael himself (or his assistant depending on which news show she went on) that he was hot on one side and cold on the other. She herself said she last SAW Michael April 2009, which is coincidentally when Murray came upon the scene. IMO, she's a shadowy figure who will probably escape unnoticed.

    Yes, thank God for Tom Mesereau who continues to speak up for Michael.

    Yes, I know WHO Cherilyn is. That was a facetious question. Who else says Cherilyn was ever with Michael? Where did she come from? Who did she work for? This is the same as June Gatling, who before Michael died, nobody knew who the heck she was. Spiritual advisor? For a Christian? No pics and no mention of her before June 25.

    Cherilyn is a nurse. Michael wasn't nurse shopping and never had a nurse working FOR him except her? Bull.

  5. Bonnie – thanks for looking into different sources so we can see the fallacy of media reporting.

    They are painting Michael as a person with drug problems as much as possible regardless of the autopsy result. When you think about it, this is what they have been doing to spice up the story and get people become interested to listen to their garbage. Well, only media brainwashed does that.

    Kenny Ortega admitted that Michael was not feeling well on June 19th so he has to be sent home. But on subsequent days 23 and 24 of June, he said “Michael was happy and healthy.” My question is, so he wasn’t feeling well on the 19th is what was taken over board by TINI members and some who want to put the blame solely on AEG preaching about as if Michael had prolonged sickness and deteriorating health all along?

    Well, I don’t feel well and most of us don’t feel well from time to time and don’t go to work for that day. That doesn’t mean our health is sliding down to a brink of death.

    How was Michael had “two wonderful days of rehearsal" and that MJ was happy and healthy. . . wasn't in distress the day before he died” if he was fragile and weak? I want to understand really what Kenny is trying to pin point. It seems to me he is saying yes, Michael wasn’t feeling well that day but he was strong and enthusiastic about the concert all along and doing his job very well.

  6. According to Wikipedia the Riot Act means “an act that authorized local authorities to declare any group of twelve or more people to be unlawfully assembled, and thus have to disperse or face punitive action.”

    Why that Kenny Ortega was asked in the court yesterday if he read the “Riot Act” to Michael? I am completely bewildered by this question. Any one has any idea?

  7. Please... please tell me, Bonnie, that you're not a member of the "MJ is still alive" conspiracy theory? Please. I came to your blog specifically to find answers but then to read you say "died" in quotes as if to say his death is an illusion. Have they bought you, too?

    It's blatantly obvious what happened and it's even CLEARER now after reading the transcript.

    June 19, Michael is in bad health. Sent home from rehearsal. This is it... this is where it became real. They now see that Michael may not do any shows, let alone 50. The financial pressure was just too strong. He had to die to pay back the near $500 million that he owed as this tour was not going to get off the ground.

    June 23 and 24, fantastic rehearsals. The call is made to Murray - end it. End his life. This is as good as we'll get from MJ, we need to end him right now to have a hope of cashing in and making him another Elvis. So, Murray heeds the call and methodically follows the instructions:

    Give him the sedatives first that will add to the final result. Wait a few hours before each dose to make the story believable. While he's knocked out, using a glove, pump propofol through a second syringe. Then, grab his hand and wrap it around so it appears that MJ was the only one to touch it. Drop the syringe on the floor for later - it will be THE KEY (PLANTED) EVIDENCE TO GET MURRAY OFF.

    Finally, the lethal dose of propofol to seal the deal. Michael is dead within minutes, while Murray is performing a lousy CPR that he knows won't do anything. It's just to kill time and make sure he's dead. Fast forward to 2011. With the planted syringe, they now have reasonable doubt. Murray will walk free, I absoluely, without a shadow of a doubt guarantee this.

    $ony have carried out the biggest (and most successful) hit in criminal music history. How ironic. I'm sure they thought so, too.

  8. @Mimi - regarding Ortega, I agree with you in that I interpret Ortega's testimony that yes MJ was not up to par one day but then rebounded. Interestingly, those two days, 6/23 and 6/24, were the days Murray said he did NOT use propofol, just the benzos! I kinda feel for Ortega, in that right after Michael's death, he said in interviews nothing seemed wrong; now under oath he seems to have changed his mind on a few things. I think he initially took the party line, however now is being truthful. Funny how people change their minds when they testify under oath! I thought Kenny's testimony helped the prosecution.

    In the context of the meeting where the Riot Act was read, it means someone got screaming mad at someone else, in this case Murray was very upset with Kenny Ortega for letting Michael miss rehearsal on 6/19.

    Yes I believe much was exaggerated by the TINI members. How much? Who knows. All I know is that when Karen gave me the email addresses of those two (Ortega & Phillips) to cyber-stalk them with multiple FB identities, she was clear that BOTH OF THEM were to be spied on. Not just Ortega and not just Phillips.

    AEG is never going to be implicated in Michael's death. There is no signed contract and the Doctor was responsible for Michael. Anyone getting convicted would be the doctor. The worst thing AEG would ever suffer is a bruised reputation, which TINI members began working to do even before June 25th.

    The Nurse was asked in an inteview how she met michael. Her answer was through a dear friend and she would not give any names. The nurse is a pawn in the game. The cook Kai chase was fired for a short time and hired back. She cooked for Bernie Mac. And Ray charles Is her God Father. Why was she hired back Im sure michael didnt go looking for her. If she cooked so great why was MJ so frail. I wonder if MJ was Poisned. I hope people paying close attention to all these clowns.

It's just unfortunate that an otherwise rational person operating an otherwise fantastic and informative blog can even suggest that Michael would leave his children, family and devoted fans heartbroken, to take up some disguise somewhere. It's disturbing to think of the rationality behind that.

    I don't belong to TINI but will say that after being on the forum, I certainly opened my eyes. Sad that your eyes, Bonnie, are well and truly shut to the true evils of Sony corp. You'd think a longtime MJ fan would have stuck to their beliefs... power corrupts.

    It is a misuse of the word and a dead giveaway of an indoctrination that began on FOK and Faye's own blog. Is there something wrong with "his" or "her" testimony/recall/statement?

    The reason I even put these new items up here is so people could see the steering mechanism in the press and the manipulation of suggestion in the press and media, not to mention the little gangs running around facebook harvesting gullible fans and implanting "truths" while selling Michael back to the very fans they have attacking others for doing the same?

    This is just the beginning. We haven't even started. This is PRE TRIAL. Let's try not to call it before it even begins. That's for the race track, not for justice.

  21. Bonnie, thanks for your coverage of the trial thus far. The timeline of that day has never made sense to me.

    Any person let alone doctor would call 911 first before doing anything else. Even a ten year old knows exactly what number to call in an emergency. I've been thinking like many of us that Murray procrastinated and effectively called everybody else to cover his own backside but that doesn't make sense either because the fact is that if 911 had have been called immediately chances are Michael could have been saved with the right equipment if they have had arrived in time. Murray didn't give them or Michael that opportunity. That is one malicious act.

    Surely, Murray would have realised that if Michael had have been saved then there would be little reason for a cover up - a few explanations or the "bad reaction" line would have done because he was the patient's doctor.

    I think it's his delaying tactics which speak volumes. Seems to me he had two decisions to make and calling 911 should have been the top priority. But he didn't. Virtually he condemned Michael by doing nothing. That's cold and that's callous.

    So okay, if it was deliberate murder then the delay was part of the plan. If it wasn't deliberate then you've got to ask yourself what on earth is wrong with this guy? Does anybody else buy the fact that this guy, a doctor, could be so stupid? I mean, I'll be honest, I'm a panicker in an emergency and fall to pieces but on several occasions at accidents and when my partner had a heart attack, I had the immediate presence of mind to call the medics. I don't buy the fact that a doctor couldn't have done the same because they are exposed to trauma regularly.

    I just can't make sense of it all. It's been bothering me for so long now. Either Michael had already expired when Murray found him or it was deliberate murder or else the whole thing is a fabrication.

    Thank you for your blog on the current preceedings. Phew, well, I have to remind myself to breath....deep breath,because this is so horrifying that I can barely believe it. Its like a really, really bad circus.

    We can only hope that Michae's defense (hmmmm questionable defense) is able to bring forth years of abuse that Michael endured before his demise on that nighmare day of the 25th of June, 2009...Can this defense do this??? Are they truthful and wise enough??? I don't know. As we constantly struggle with this injustice and wonder why. Why did this have to happen to a man who's only aim in life was to share peace and love and care for others and our planet??? "I'm standing though you're kicking me". (MJ) He lived this every day, every night. He always held his head up high, doing what he knew was right and good. There are earth angels, and yes, Mesereau is one of those. Then after him, just a hand few that would stand up for Michael. Then there are the gouls behind the masks that need to come forward and tell the world how they delibertely framed Michael for all his trials, whether it be for greed, hate or money, or all of those in combination. They did it. This ALL needs to come into the light in this trial for any true justice to be served. And then in the end, none of it will bring him back. Let those who belittled and tried to shame Michael try to say one more evil thing about him again if this is even remotely achieved. But as you said, "Its going to get worse before it gets better". :((( This is the sad reality. Then there is the time factor involved. Its going to take a long time. I derive my hope from the fact that there are so many who love Michael and with this love, and standing strong, the truth wil prevail.

  25. P.S. Bonnie, thank you for your intelligent explination to "Exodus" above. Because as you stated, the press is already having Michael framed as a drug addict who most likely killed him self. That they have done - - - I remain hopeful that Michael is alive until I have solid proof otherwise, just as you said.
