I am listening to HLN right before the trial starts and I think it’s funny that they think the only reason Dr. Metzger was called was to discredit Michael.  They think Metzger damaged the defense’s attempts to make it look like Michael was responsible for his own death.

One of the questions posed by the commentators was “Where is the defense going with that, with putting Dr. Metzger and Nurse Cherilyn Lee on the stand?”  They don’t see what’s going on with the surrounding Doctors on Facebook.  They aren’t even questioning Nurse Lee’s confusion about her own notes, and why Michael would even need super vitamin IV infusions when he was not even rehearsing yet.

Personally, I don’t think the defense’s strategy is to put Michael on trial.  You don’t put hostile witnesses on the stand unless there is an underlying purpose, because they always, always reveal themselves and both Lee and Metzger were hostile witnesses for the defense.

Randy Phillips is supposed be called to the stand (they say) sometime today.  Surprise witness that will really shake things up?  I don’t think that’s him.

As we wait, I want to apologize for yesterday for burdening you all with what was going on with me and my family.  I will try to keep personal stuff out of the blog.  Thank you all very much for your prayers.

Chernoff still Directs Cherilyn Lee 


- Well before any questions could be answered, Cherilyn Lee gets really flustered, on the verge of tears, she tells Chernoff that she has the information organized but she’s feeling a little dizzy and her vision is blurred.  When the judge asks her if she would like to rest for a few minutes, she looked at him and said she would appreciate that very much and her voice gets higher and starts to break as she seems to be fighting tears.  She must be under some kind of pressure that is outside this court room.

-She comes back and Walgren tries to clear the dates up between the April 12th Easter Sunday and April 19th.  This was for sleep issues.  Both April dates were a Sunday.  April 19th was in the morning.  She says this is the night she had to come back and watch him sleep.

- Lee said she went up to his room some time after 11pm.  She said he expressed his need/desire for a particular drug and he said Diprivan.  (Then she said he actually said that, that morning.  She said she and Michael went back and forth about it because she didn’t know what it was.  She said Michael told her that he has a lot of problems sleeping and the only thing that helps him fall off right away is Diprivan.  She said she offered other natural remedies including light in the room, sound, electronic waves around his head which she said would cause sleep problems.

-Lee said Michael never talked about WHY he had trouble sleeping, just that he had trouble sleeping.

- Chernoff asks about Michael’s expression/emotion when he talked about sleeping and needing the Diprivan.  Lee said he looked at her and said, “I have a lot of difficulty sleeping.  I need something that will help me fall asleep right away.  The only thing that has been able to help me do that is Diprivan.”  Lee said she didn’t know what it was.

- Lee says Michael seemed to have a familiarity with it.  She then researched what it was.  She called a doctor, and asked what Diprivan was.  (she didn’t name the doctor).  She learned it was used in surgery, and never used at home.

- She called this doctor during the day, leaving the room and coming downstairs because of cell phone reception.

- Michael told her that doctors have told him it was safe.  I just need to be monitored.  Lee told him no doctor will come out to the house to do this, and Michael said, “no, I just need someone to monitor me”.

- Lee said she told him she wanted to try the supplements one more time.  When she went back that evening, she showed Michael the PDR about Diprivan.

- Lee said Michael told her he had it administered in the past during surgery.  She said Michael told her that when he woke up from surgery he didn’t even know he was asleep that long and wanted to have that experience again.  Lee said Michael didn’t tell her that any doctor had administered this to him outside of surgery.

-Chernoff asks her if this part of the conversation is from memory or from her notes.  Lee said in her medical notes . . . then she says she can’t find it.  Chernoff asks her “have you thought about this every day for the last two years?”  Lee says not every day.

-Lee said Michael never mentioned any specific doctor, not Klein, not Murray.

- Lee said when Michael woke up on the on the 19th/20th  he was a little upset that he didn’t sleep longer.  Lee said after looking at her notes that Michael said “I’m telling you, the only thing that is going to help me to sleep is the Diprivan”.

- Lee said, “Now that I have not been able to sleep all night this is going to mess up my performance for rehearsals.  The natural remedies are not working”.  She said Michael gave her a hug and left.  She never saw Michael again and he didn’t call her again until June 21st.

-June 21st she got a call from Faheem Mohammed.  It was in the morning.  Mohammed said Michael wanted to see her.  She said she could hear Michael in the background telling Faheem “tell her what’s going on with me.  One half of my body is hot and one half of my body is cold.”  She told Faheem that someone needs to take him to the hospital.

- Lee said she went through a battery of symptoms in the PDR.  She did remember telling the police about it and that she thought it was a central nervous system problem, a depressent.  Chernoff said according to her testimony to police on July 9th, 2009 she told the police that she felt something had been introduced into Michael’s central nervous system.  She says she did not have any idea what Medications Michael would have been on.


Walgren Cross

- Asks what year she got her PhD in Hollistic medicine. She couldn’t remember, but thought it was around 1986.

- Walgren reviews her first meeting with Michael and the circumstances of that.

- He asks about her keeping medical records. And she said yes.

- Red Bull cans were left laying out in the open, she noticed that he drank a lot of these.  That there was also problems with lights, music, movies going while he was trying to sleep.

- Walgren brings up discussion about Michael telling her people would have to mop up the floor from him sweating during concerts and that he lost a lot of body fluids.

- Vital signs going across, blood pressure, pulse rate, resp rate, asked his weight.

-  Walgren goes over her notes and mentions she wrote down “proceed with the plan” and to draw bloodwork.  He had small veins, was difficult.

- Told Michael to discontinue all the Red Bull Drinks.

- Walgren goes through progress notes of February 2nd, February 3rd, February 5th.  He goes to Feb. 16th in progress notes she discusses the lab results. At the bottom of that page, “the continuing plan” is he needs to discontinue the Red Bull.

- Second lab tests were done to see how effective the treatment was and there were improvements (in vitals???)

- March 9th, vitals are noted again, notes and recommendations.  Lab results were reviewed. 

- March 13th, ongoing treatments and recommendations noted.

- March 16th – notes Meyers cocktail and further nutritional substances are noted.

- Documentation continues through March 20th, 24th, 26th, April 12th 2009.  Michael complains about needing sleep.  April 19th, energy is great but is unable to sleep well, natural products are not working.  Plan for action, high protein smoothies, cocktails and B12 shots.

- Met with Michael morning of 19th, Walgren brings up the conversation and Michael wanted her to observe him sleeping.  He said he needed something to “knock him out”.  Walgren reviews that she did not know what Propofol or Diprivan at that time.  Then she researched it.  Told Michael it was not safe to use at home and that Michael responded that he would be safe that he only needs a doctor to monitor him.  She then she showed Michael her PDR on the side effects?  As she was going through the symptoms, one of the symptoms was memory loss.  Michael said he responded that Michael said he would never forget his lines, he only needs someone to monitor him.

- Walgren goes through his notes.  He read what she wrote, that she told him “but Michael what if you don’t wake up.” And that Michael responded “I only need someone to monitor him.”  Cherilyn then gets emotional and said “That’s exactly what he said.  Then she never saw Michael again after the 19th when she refused to find a doctor that would give him Diprivan.




Chernoff redirect

- Lee says she did talk to others prior to the police.  Chernoff asks who she interviewed with, Larry King and several others in the media.  One patient is a P.R. person and she had contacts. Then she talked to the police .  (How did this other patient know she was seeing Michael Jackson???)

- Cherilyn can’t remember what time Faheem called.  She only knew she was in the emergency room, she was exhausted.  (Florida).

My comments: - I have a friend that wrote to me and told me “my mother has B-12 shots every three months.  I told my mother that this nurse was giving Michael several along with these cocktails and she pulled a face and said that every three months is sufficient (remember, Michael is not even rehearsing yet, so how much energy does he need and why does he need it?  Is something being put in his food? What’s going on?)

Days after Michael’s death Cherilyn Lee is on CNN (same news of choice for TINI) giving an interview.  How did she get this interview?  She said one of her other patients is in the media and has high connections.  How did THAT PERSON even KNOW that Miss Lee was treating Michael?  Was Miss Lee a plant herself?  She after all acquired her famous patient from the body guard Faheem Mohammed.

Lee is apparently seeing and giving Michael IV nutrition at the same time that Murray is allegedly giving Michael IV infusions every night to help him sleep over the month of April before Cherilyn’s last visit.  Somebody is lying.  Either that or Cherilyn is keeping Michael awake while Murray is trying to help him sleep.  Chemical warefare!

She doesn’t name the doctor she contacted about Diprivan, she doesn’t name the person who’s in the media . . . she apparently has respect for HER privacy but not for MICHAEL’S given she was all over the media giving interviews not more than two weeks after he passed.

Where did Faheem Mohammed come from, Where in Florida did Cherilyn go and why did she go.  She can’t remember when she got her doctorate, she got it from an online school in the mid-eighties (we didn’t have internet schools in the mid-1980’s!, we didn’t even have commercialized internet until 1995!)

The Internet was commercialized in 1995 when NSFNET was decommissioned, removing the last restrictions on the use of the Internet to carry commercial traffic.”  Source

Most disturbing is her connection to the sports/entertainment industry and her patient friend in the media, who couldn’t wait to get her on T.V.  Possibly Michael let her go NOT because she wouldn’t give him Propofol, but because he was onto her.



Chernoff calls Amir Dan Rubin
Hospital executive - Standford

- June 25th he was chief operating officer for UCLA Medical center.  Chernoff asks him to give him a brief rundown on the layout of UCLA hospital.  The inpatient unit is in one building but there are other buildings annexed to the hospital.   His office is on the first floor, west side. (??? Why asking this?)

- ER is through some doors and some hallways a couple hundred feet north from his office.  Walk through lobby, enter doors and into ER waiting area.  There were doors to the outside from the ER area and administration area.

- Chernoff asks if he remembers the death of Michael Jackson.  Rubin says yes.  He had been called by the ER that they had a person of interest and they might need his assistance.  They did not say who it was over the page.  He went to the E.R.

- He saw ER people working as usual when a patient is being attended to.  He said he didn’t know the precise time.  He wanted to make sure the area secured, called security and called for broader security and privacy shades up on various windows and move any additional people to other areas.  He only knew names after the fact.  When he first came to the ER room, there was security type people from the patient’s staff, they had ear pieces, etc… 

- He doesn’t recall seeing Dr. Murray or knowing who was Dr. Murray, he only saw people.  Rubin said he initially was moving around the ER for about 45 minutes coordinating with other parts of his team, conference room, security and privacy for family.  In conjunction with ER department they coordinated the conference room for the police, one for the family press and for administration.

- A meeting was held in one room to discuss a press release.  The CEO of AEG Live and a gentleman w/ public relations were working on a press release, head of P.R. at UCLA, then Jermaine Jackson and others in and out of the room.  He wasn’t static so he doesn’t know everyone involved in that.

- Rubin testifies to a time of approximately an hour and a half after getting called to the E.R.  Press release was given in a basement room auditorium by Michael Jackson’s brother.

- Says he saw Murray briefly in the conference room.  Rubin observed him reading the AEG press release.  Some commenting on the press release, Murray said reason for death is “not known at this time”.  Murray was dressed in T shirt and jeans.  Looked a little distressed, shared by everyone in conference room. 


- Chernoff names Randy Phillips as CEO of AEG as one of the people Rubin saw in the press conference room.


Walgren Cross

- asks about demeanor about Dr. Murray.  Rubin told the police that Richelle Cooper walk into one of the rooms to tell Mrs. Jackson that her son had passed away.  Rubin said “presumably that is what she went in there to tell her.”  Walgren read part of a statement Rubin made to police, that he could “hear the anguish of a mother who had lost her child and it just was not a good thing to hear”.

Walgren closes his questioning . . . no cross.


My thoughts: - The interesting thing about this interview is the melee that ensued once Rubin learned it was Michael Jackson.  Not only was back up security called from around the campus of the hospital but he also mentioned moving people to different areas and the putting up of privacy shades on windows in different parts of the hallways and various rooms. 

Why?  Isn’t the decedent covered when they are taken to the morque?  Isn’t the morgue in the basement of most hospitals?  Doesn’t the coroner usually use an underground garage to pick up the decedent?  That was the only odd thing that struck me about his testimony.



Chernoff Directs Randy Phillips

Alternate one has to use the bathroom.  Randy Phillips waits on the stand.  I can imagine him rolling his eyes . . . (do I get lunch?).  Judge Pastor still very animated and jovial, cracking jokes about not telling alternate one about lunch already being there.

- Wow . . . Randy is too close to the mic.  Thankfully he backs up a little.  He is swiveling in this chair.  Randy is asked about the parent company, concert company, own venues, sports companies.  Sports and facilities operations and management.  They also operate the O2 in London.

- Phillips is asked about the O2 Arena, will hold to between 8 and 16 thousand, a little more for sports.  Max capacity is about 19 or 20 thousand.  They opened in in 2005, 2006.

- Phillips has been CEO of AEG Live for 9.5 years.  He is in charge of booking talent, managing profit/loss etc… Phillips testifies that their objective is to showcase the best talent, giving them the best venues to operate in.

- Chernoff asks about the Staples Center (own/operate are different).  Phillips testifies that he attempts to book the appropriate venue, not necessarily only ones they own.  Many shows are world tours, but they do also a series of shows in one venue.  Ex. Prince did 21 dates at the O2, Beyonce did 8, Justin Timberlake did (missed the number).  Randy worked at a record business previously with Gasoline alley – Steeple/Phillips entertainments, (Randy said too long in the entertainment industry then said “sorry”) 30

- Phillips first account with Michael was early 1990’s where he represented Michael in a deal for L.A. Gear.  More as an consultant, reporting to John Branca.  It was through John Branca.  He brought the L.A. Gear to them with Jay Coleman.

- He did not have a relationship with Michael post L.A. Gear deal.

- Next came in contact with Michael business or personal.  A meeting in 2007 was the next time.  Peter Lopez had contacted Phillips about meeting with Michael in Vegas. 

- Paul Gongaware took over the management of a tour in 1996 of Michael’s. That company got folded into AEG which is how Gongaware came to work for AEG.

- Before meeting with Lopez there was no contract.  Lopez represented Michael Jackson in 2007.  To the best of Phillip’s knowledge Lopez was the only representative to Michael at that time.

Chernoff continues direct with Randy Phillips

- Phillips said the meeting with Lopez was about getting Michael on stage again.  AEG was very interested.

- Phillips said he could not exactly recollect when Michael was last in concert, but assumed it was late 90’s.

- He didn’t’ know where Michael was living. Raymone Bain, a lawyer named Cross, Bain’s assistant, another gentleman, other agents and executives attended the 2007 meeting. It was held at Turnberry Isle wine tasting room.  Discussions lasted about an hour and a half, no resolution.  In 2007 there was further contact with Lopez and Bain but not with Michael Jackson.  No concert scheduled as a result of these negotiations.

- Phillips said then it was readily apparent that Michael was not ready to take the stage.

- Late August 2008 was the next contact.  Tom Barrack from Colony Capital contacted him.  Judges asks Phillips to spell Colony and he spells capital instead.  Murray smiles.  There are numerous partners he said with Colony but Barrack is the one that contacted him.  Phillips was directly contacted by Philip Anschutz.  When the boss called Randy set up the meeting with Barrack in Century City, California. 

- the next day or day after Barrack and partners and Phillips met.  Richard Nenoola let the meeting.  Colony had purchased the note on Neverland from Fortress.  Phillips, Nenoola and Barrack discussed a concert then.

- They set the meeting with Phillips  and Tohme during that meeting at Colony.  It was set at the Bel Air Hotel in August of 2008 –Same week of meeting with Colony.

- Discussion was about Michael Jackson restarting his career but he wanted to also put out new music during the tour.

- Phillips followed up with phone conversations, and other meetings, negotiations for Michael to return to the stage.   Some with Attorneys - Dennis Hawk and Peter Lopez.  First face to face with Michael was in September in Bel Air Hotel with Tohme and Michael and some of his body guards but not in the meeting.  Phillips knew them vaguely.  This is the first time Phillips talked to Michael about the possibility of concerts.

- Parameters were previously discussed with Tohme, of the concerts.  The plan with Phillips and Gongaware and other executives – was to start in London as a residency.  That was the first phase.

- Phillips stated that first phase plan was discussed with Michael at that September meeting.  Michael was receptive.  It was apparent to Randy he was motivated and energized and receptive to the idea.

- Another meeting on this at the Bel Air Hotel.  Money was never discussed with Michael, discussions with him were mostly creative.

-  Michael, Tohme and Phillips, kids were dressed in costume for Halloween (October 31, 2008).  Michael was expressing he decided to restart his career wanted to settle down and get a really good home for the kids, not living like vagabonds.  It got emotional when he was describing how he had to live.  Randy said he cried and Michael cried.  Michael was tired of living like that.

- About an hour to 90 minutes.  A contract was signed for 31 concerts as he wanted to do ten more than Prince did . . . Michael came up with the number.  Contract was signed in January of 2009 at Michael’s residence.  Michael signed first.


Chernoff is trying to ask about the contract but the prosecution doesn’t seem to want to let Chernoff ask these questions.


- Concert went up from 31 shows.  Chernoff is trying to establish the terms of the contract and whether it included the cost of living expenses for Michael.  Walgren is not letting him do this.  This I feel is important to establishing Michael’s state of mind just as it is important to state who came up with the terms of the contract, was it Michael’s idea or AEG’s?   Is it relative to cause?  Yes.

- From Jan to March of 2009 was there any production.  Phillips says none.  Chernoff had to reword “contract” to “agreement”.

- Chernoff asks about the 10 concert teaser, which is where the number ten came from.  Phillips said he initially put ten shows.  Promoters never advertise all their shows, because it dis-incentivizes early ticket sales.

- Discussions with Phillips between Jan and March were artistic, with Paul Gongaware they were production related.

- Press Conference set up in March at the O2 by Phillip’s staff .  Michael was scheduled to speak at the conference.   Walgren will not let Chernoff ask about the press conference.

- After the press conference, and after announcement  sales were over the top.  A pre-registration was done so Michael could build a database of his fans to sell music to directly through Michael Jackson Live.com  Phillips said he never saw such a response for tickets.  Phillips describes Gongaware’s phone call – “dude could you call Dr. Tohme and ask if Michael could do more shows because this is an unprecedented demand”.  Phillips was put on the phone with Michael and Michael wanted no more than 50 “he didn’t want to live in London and have to get a new passport”, and find an estate to lease outside of London with stream, horses, 16 acres. That was part of the condition.  He didn’t want the kids living in a hotel in the city, not able to get out.

- Randy was working to get the shows finalized.  Production didn’t really get in gear until about April.  Michael brought people on board to help with the budgets.  Michael told Gongaware he wanted Ortega to be director.

- In April Kenny had arranged for production designer, Michael Cotton, Travis Payne, hiring of other staff – other creative meetings were going on.  Auditioning dancers also occurred.  With personnel in place, Randy was not sure when rehearsals actually started, but he believed they may have started in May but he’s not sure.

- Chernoff goes back to early May, discussions about a personal doctor.  Randy says it was a conversation he had sometime in May.  Phillips was not initially involved in those discussions.  Randy stopped by the forum one day in later May.  He was walking in the hallway, Tim Wooley and Gongaware and Frank DiLeo told Randy Michael wanted to hire his own doctor to take on tour.   Randy called Michael Amir and set an appointment to talk to Michael about this doctor.

- Randy told him it would be expensive to pay a doctor 24/7.  He said Michael was very firm and said no.  I need my own physician 24/7 on tour with me.  Randy said okay and that he would have Gongaware take care of the negotiations.  Phillips had never had a discussion with Michael and had never met Dr. Murray at this point.

- Phillips met Murray at Michael’s house for the first time in very early June, 1st week on a week day, late afternoon probably 4pm or 5.  Gongaware and Dileo called the meeting to discuss what Murray was going to do with Michael.  DiLeo had concerns with Michael losing weight and discuss Michael’s general health.  Ortgega was NOT at that meeting.

- Randy said no concerns about Michael’s performances in May.

- 1st meeting in June, Phillips remembers Murray saying he would make sure Michael would get proper nutrition, high protein drinks.  Murray said Michael was in great health.  No other discussion about Michael’s medical history.  Phillips was satisfied with Murray’s responses about Michael’s health and weight.  Michael had great trust in Murray at that meeting.  Phillips said it appeared that Murray had a close personal relationship with Michael.

- Randy had no reservations hiring Murray for the tour after that meeting.

- Michael was not expected to be at all of the rehearsals.  Phillips said there was a concern more toward the second week of June by Ortega.

- No concern in May – Not in early June.  Ortega started getting concerned that Michael was not as engaged as he should be.  Ortega spoke to Gongaware and DiLeo first.  Phillips was not consulted until later.

- It was supposed to move to London in June 25th.  Ortega’s main concern was Michael’s focus and performance.  Phillips called Amir Williams and told him Michael needs to be at these rehearsals, that he was the focus of the show and everyone needed to cue off of him.

- 20th of June a meeting at Michael’s house.  Michael was not at rehearsals.  The email between Ortega and Phillips, Phillips said he got the email in the middle of the night.  He wasn’t sure Ortega meant about the tough love part.  There was concern that Michael wasn’t taking it seriously.  There was not a concern though that the show wouldn’t go on, just that they would have to move it back to be technically ready for the size of the production.  He said no one on his end was ever contemplating pulling the plug.

- Phillips said DiLeo who was out of town when he received the copy, called Phillips and asked him to put together a meeting with him, Murray Ortega and Michael.

- Phillips said he called Murray to set up the meeting.  Ortega never mentioned drug use by Michael Jackson.  Phillips said he remembered he went up to Murray and said that Klein was also treating Michael and left it at that.  Phillips wanted Murray to know about that because Michael was usually razor sharp and a perfectionist.

- Phillips said He asked Amir Williams if everything was okay and Williams replied, nah, he just came from Dr. Klein’s office, which is why he mentioned it to Murray and that Murray should know.

- Phillips said in Ortega’s urgency you could probably classify it as an emergency meeting, but he didn’t like using that term, it sounded alarmist.  He believed it had mostly to do with Michael’s focus.

- Murray, Michael, Ortega and Phillips at Carolwood.  Phillips said he called Ortega and either emailed or called Murray to set up the meeting.  Phillips doesn’t remember but he may have forwarded Ortega’s email.

- Ortega opened the meeting saying Michael needed to focus and needed Michael’s participation and attendance for the production.  Phillips said he was calm.  Michel didn’t respond immediately.  Murray spoke for him, guaranteed that Michael would engage.  Michael then said that he was working with Travis Payne on  the routines.  Michael’s quote was “you build the house, I’ll put on the door and paint it”  Ortega was happy, said “great”.   Phillips said Murray told Ortega he should worry about the show and leave Michael’s health to him.

- Phillips said prescription drugs and use of such was never a concern and was not mentioned.

- Phillips showed up at the 23rd and 24th.

- 25th of June DiLeo called Phillips that Michael was having trouble breathing, the he needed to get up to the house about 10:30 or 11am.

- Phillips got in the car and sped up to Michael’s house.  It took about 15 minutes.  The paramedics were leaving as he was coming, with two black SUV with Michael’s security and children.  Phillips then got behind them.

- Phillips was there all day into early evening.  He saw Murray in the ER as he and DiLeo sat on a gurney in the ER waiting room and then later in the afternoon for the press conference and how to announce it to the public.

- Phillips said he did talk to Murray and that he was in severe distress.

Chernoff  passes witness and they take the afternoon break.

- Walgren begins asking Phillips about the wording in Ortega’s email about “pulling the plug.  Phillips responds that he remembered seeing the wording in there but that it wasn’t something AEG could do unilaterally because it was a contractual obligation on both sides, it would have to be a mutual decision by both parties.

- Walgren asks and Phillips responds to questions about his first meeting with Michael as Walgren reviews what Phillips said to Chernoff.

- Phillips had no knowledge of Michael’s treatments (with Murray).

- Confusion here as to which meeting Phillips originally noticed Michael seemed  less focused and not typical at all to his sharp attention to detail.  Phillips said he asked Michael Amir on his way out “is he okay?” meaning Michael Jackson.  Amir had responded “he just came from Dr. Kleins”.  Another time Phillips said that he called to talk to Michael and Amir Williams declined explaining he had just come back from Dr. Kleins.

- At the June 20th of 09 meeting, Phillips said it was then that he told Dr. Murray that Michael was seeing Klien and “were you aware?”  He said Murray responded something like “he would check into it”.  Phillips wasn’t sure if Murray already knew.

- I missed the question (husband came home) and I heard Phillips respond with the statement that Michael was a genius (question was something about Michael’s state of mind), and had extraordinary attention to detail, and Phillips never felt that Michael wasn’t motivated or ready for the tour.

- Walgren asked about how they got from 31 to 50 shows and Phillips reviewed what he told Chernoff, that Gongaware first contacted Randy and told him he had to ask Michael if they could add more shows.  Randy reiterated that the proper protocol was that he call the artist’s representative, which was Tohme.  Phillips said that Thome said no more than 50 shows. Then about 20 minutes later Amir Williams called Phillips back and Michael got on the phone with the demands of a residence outside the city with enough acreage and privacy where the children can go outside and not be locked up in a hotel room.

- Phillips reiterated that Michael was a phenomenal father and that his demands were for their comfort, and that they were everything to him.  Last demand Michael had for the agreement to 50 concerts was the attendance of the World Book of Records because no other artist had ever sold out 50 shows.

- Walgren asked about Phillips first meeting with Murray again and Phillips stated Murray told him Michael was in great health and that he felt Michael had a great trust in Murray.

- Walgren goes back over Phillip’s testimony about the email from Ortega early morning 20th which prompted the meeting at Michael’s Carolwood house later that day.  Phillips said Murray reassured them that Michael would be better at making rehearsals and that he was fine.

-Phillips confirms his previous wording about the meeting on the 20th of June and what Murray said to Ortega.

- Walgren asks Phillips about June 25th and when he actually went over to the house.  Phillips said morning, but Walgren got him to agree that was probably closer to early afternoon.  Phillips said the night before, on the 24th was an amazing rehearsal.  He said Michael gave a close, firm hug to Ortega and Payne and Phillips walked him down the back hallway out to where the underground loading garage was.  Phillips said Michael put his hands on Phillip’s shoulders and said that “you got me this far, I can take it from here”.

Chernoff redirects

- Chernoff asks Phillips again about the concerns that came up in the June 12th and June 20th meetings.  Chernoff asks if this is why the concerts were pushed back but Phillips answers that it was technical production related and had nothing to do with Michael or his health.

- Chernoff again asks Phillips about the “pulling the plug” in Ortega’s emails (this is the same email that does NOT mention Michael by name).  And Phillips answers with the same explanation, that it wasn’t up to AEG, they couldn’t just breach a contract.

- Now this gets interesting.  Chernoff tries every which way to either ask about production costs, ask about the rental on the Carolwood property and the objections keep getting sustained.  What surprised me is that Chernoff also tried to ask about the cancellation policy and the objection is STILL sustained.  Why?  Prosecution was allowed to ask Gongaware about that.  It’s evidence already discussed why couldn’t Chernoff finish questioning here?  I got even got frustrated over that one, I can feel Chernoff’s frustration.

- Chernoff has Phillips repeat explanation of how he came to know Doctor Klein was treating Michael (we keep going back to Klein) and Phillips again explains that Michael Amir told him at an earlier meeting when Michael seemed unfocused and Phillips asked Michael Amir if Michael Jackson was okay.  Amir had replied “he was at Dr. Kleins).  Chernoff misstates what Randy said and Randy corrected him, “That’s not what I said”, before explaining.

Chernoff finishes with Randy Phillips.  No recross from Walgren and Phillips is allowed to step down.


My Thoughts: - While we wait for the next witness to take the stand I hear HLN in the background discuss that Chernoff seemed to be firing off questions even though he knew they were going to be sustained objections (my thoughts exactly) because even though the jury will be asked to disregard, they can tell where Chernoff wants to go with the questioning and he is planting the seed.  She actually said the words “The jury can read between the lines”  . . . Where have we heard that before.

What I got out of this witness is that (gasp) Randy Phillips cried, so contrary to TINI campaigns of the past, Phillips has a heart (and rumor has it, a personality too).

As I listen to each witness and especially the last couple from the defense (Cherilyn was another big one) it seems to me that the purpose of the defense has been more about name-dropping then actually finding a defense for Murray.  (I know, some of you don’t believe he has a defense).

In Cherilyn, she brought out connections she had with the media (one of her patients got her on the T.V. interview circuit within DAYS of Michael Jackson passing) and Michael’s body guards, which is how she even got to Michael in the first place.

With Phillips, he had worked with Michael before, but more second hand, through John Branca and  L.A. Gear.  Randy as we covered a year ago had gotten his start with Gasoline Alley Records which later was sucked up into the Universal Music Group.  But through those connections Randy brought the names of John Branca and Jay Coleman. 

More recent people surrounding Michael, Randy brings the names of Peter Lopez, Raymone Bain and a lawyer named “Cross”.  Also Philip Anschutz is finally mentioned Tom Barrack and a partner, Richard Nenoola and lawyer Dennis Hawk with Lopez.  (Not sure of spelling on Richard’s name).  Phillips brought a whole lot of players on the board.  This is like reverse chess.  Or maybe it’s football, where the players are named one by one as they run onto the field.

Overall, I don’t believe Phillips added or subtracted to the defense of Murray only to say that he believed Michael trusted Murray, and that he didn’t have any reservations about Murray after meeting him.

His comments about Michael were incredibly personal.  He described Michael as a genius, as having incredible attention to detail and razor focus.  He also described him as a phenomenal father and he seemed to want the jury to know that Michael’s demands for  the contract centered around the needs of his children not for his desire for extravagance. 

But the most telling I believe, aside from all the names I am now going to have to look up, is the first meeting with Michael in the Beverly Hills hotel room, where both he and Michael discussed what he had been through and what his children had been through.  Reading between the lines, I’m sorry but I cannot see this meeting as your typical CEO/Artist meeting.  Phillips knew, after that meeting, at least a tip of the iceberg about what Michael had been put through and I was surprised that someone like him would admit that he cried.

We all have cried with Michael/for Michael.  I would have loved to have heard everything they had talked about.  This also tells me that Michael had been trying to keep the demons away since he left the country in 2005 and he was sick and tired of running and hiding and trying to avoid them.  He was sick and tired of being afraid to venture out doors, go into a store or flick through a television set on the risk his children might be exposed to what they were saying about their father.

He was sick of it.  Phillip’s descriptions of Michael tell me Phillips understood that.

I do not believe Phillips is a bad guy, especially after his testimony.  I didn’t believe it before, but today verified that for me.

- Clients include defense lawyers and police departments and provide forensic testing services.

- August 31st urine samples from LA county coroner’s office.  Scene urine and autopsy urine.  Tests on total Lorazapam (includes metabolite).

- measuer 12.9microgram per mil.

-  autopsy 15, 181 ml 15.1 micrograms.

- Flanagan sets up foundation for determining how many pills it would take to get to the level of Lorazapam found in the blood from the autopsy.

-  from 2mg pill you get 0.21mg, elimination half life is 12.9 hours.  Henson uses a medical calculation formula published in an article to figure this.

- Flanagan is trying to get Henson to answer  questions pertaining to calculations he made based on Dr. Shafer’s charts and Walgren and Judge is not letting him do it even though he already laid foundation of what calculation method he was using.

- Flanagan has to backtrack after approaching the bench, deeper into Henson’s training and expertise, which he does, including having to determine therapeutic levels of drugs on someone’s system for various clients.

- Henson describes how he runs those tests.  (Too boring to type).

Flanagan says he has nothing further and Judge asks if council would like to approach.

There is only 15 minutes left to the end of the day after the attorneys converse at the bench, so court never gets back in session.  Flanagan is tired of being stonewalled.  Court adjourns for the day.


My thoughtsEven after Flanagan was asked to establish foundation for expert qualifications, this witness was not allowed to testify to what he calculated based on Shafer’s models.  I am beginning to think that the prosecution was given a lot more lead way with their case then the judge is giving to the defense and it’s starting to tick me off.

While Flanagan is not my favorite interrogator, he does have a lot more experience with the medicals and is more organized with the terminology and the numbers than Chernoff in that profession.  I don’t even know if Henson will be back tomorrow, since they are not even allowed to direct their own witness.

    With the testimony about Klein, I am in disbelief that he will not be called as a witness and can't help but wonder why since it is apparent that he contributed to "Michael's condition", drugging him. Is the FDA protecting him or is someone else?

    I can't help but believe it's all an illusion.

    We have people close to Michael now holding important positions within the corrupt system. That could go either way...ears on the inside or turncoats.

    With faith, I remain open to possibilities...

  4. @BONNIE : As Dr. Metzger said he never gave Propofol to Michael, did Phillips really cried with Michael ? we don't know really but I do believe Phillips relating to Michael's distress after 2005 : it makes us love Michael even more. But honestly & contrarily to my previous fears, I found R. Phillips was OK yesterday : he is a business man after all with large financial responsibilities. Human ? maybe but show business is tough anyway.

  8. Several things about the whole Cherilyn Lee watching Michael sleep issue:

    1) I believe she stated this was to occur "in his bedroom". Yet, we have been lead to believe that Michael didn't allow anyone, including his children, into his bedroom. (I don't believe that, especially the children.)

    2) I thought he was suspicious of people, didn't know who his friends were and didn't allow people alone in his private space. Him being asleep is her being alone.

    3) How the heck could someone sleep when they're being watched? That adds an unnatural factor that certainly could affect sleep. It is a scenario that would not accurately replicate his normal/abnormal sleep patterns. (I can feel someone watching me and I should think Michael could too.)

    4) Michael - a shy and private person, which makes it all the more unbelievable.

    5) By default, a doctor/nurse believes a patient's concerns. Why the need for a demonstration?

    6) Simply watching someone sleep does not give insight into what is going on in their brain or life to cause the disruptive sleep.

    7) Lee is not a sleep specialist. Natural remedies are more general and work over time, not instantly like a multitude of drugs supposedly for very specific symptoms. Michael had to know that.

    From what I recall, Lee said Michael slept 5 hours that night. For some people, that is a significant amount of sleep.

    "- Lee said, “Now that I have not been able to sleep all night this is going to mess up my performance for rehearsals. The natural remedies are not working”. She said Michael gave her a hug and left."

    Somehow, that just doesn't sound like Michael.

    Michael left...left his home and Lee in it?

    Did she ever specifically say that she DID stay and watch him sleep and where in his bedroom she was positioned? I have to go watch that part of her testimony again, paying attention to her wording because that statement above by Lee, quoting Michael, has loopholes.

She said (paraphrasing) everything is like illusion there is more things than this trial is telling us, and read between the line.

    Bonnie, I know you told us many times every conspiracy that surrounded Michael and how deep it is. But how is that we are suppose to read between the line from this trial to find the truth? What is the clue, I really want to know and I am very curious.

    Okay . . . what DID Metzger give him? (I don't believe he's truthful, he's been on tour with Michael . . . WITH the IV's that even Michael testified to walking around with).

    Phillips - is it POSSIBLE for anyone to make us love Michael any more? I did hear some things new from Phillips in regard to the stipulations Michael wanted in order to agree to do the 50 shows. Randy, even though I believed since last year that he didn't have anything to do with Michael's passing, still did surprise me that he wanted the jury to know that Michael was a fantastic father and that Michael's demands were for his children NOT for his ego. So Randy ended up being a character witness not so much for Murray (Michael trusted him) but also for Michael.

    ....... There is a mark/scar on his leg that was NOT mentioned on the autopsy. The spider bite was pretty nasty (brown recluse bite, I have pictures on one of the blog updates where I talk about this). That scar will probably always be there. Yes the whole body is usually photographed and without the sheet.

    Whew - that was a long post of yours!
    My mother has B12 shots every 12 weeks. She has pernicious anaemia, which means she can't absorb B12 through her stomach. This is an auto-immune problem. Vitiligo is an auto-immune problem.
    So, I was right, Thome agreed to the 50 shows AND THEN Michael spoke to Randy 20 minutes later. Knew it.
    I don't think Randy Philips is a bad guy either, BUT I HAVE NOTICED HOW CAREFULLY HE DEFELECTS ONTO OTHER PEOPLE. Nobody told him, he didn't know, it was everybody elses fault, he isn't responsible. Round here we call that Teflon-man cos nothing sticks to them. It reminds me of my friend's ex-boss, you remember him don't you, the one that felt the force of corporate bullying? Oh yes, everything was rosy in the garden, so my friend was over-sensitive was he?

    1. True - even the press described "Karen Faye" as one of the few people Michael allowed in his room. (which I don't believe either, but could have happened back when he trusted her).

    I don't believe Michael would have ever thrown out natural remedies for drugs, especially, ESPECIALLY knowing what he went through in the early 1990's AND knowing what we know now about people controlling him and drugging his sister. He has CHILDREN! They CAME FIRST. Even Randy Phillips attested to that and he supposedly didn't have that much exposure to Michael but he knew that much!

    Another Michael is being presented to us that I don't think is reality. The DEFENSE has not even gone after Michael's character but the characters of those WHO WERE AROUND HIM. In listening to Chernoff or Flanagan ask doctors if it is possible for someone to infuse more propofol while the doctor left the room, they NEVER said Michael's name. ANYONE could have come into the room.

    Not saying that Murray shouldn't have left the room or even had the propofol THERE. But did he do anything that killed him? I believe no.

    How are we supposed to read between the lines? Look at the real purpose of this trial. Murray = Fall guy. Look at all the names that have been dropped, the associations and the linking between them all like I what I showed above with Cherilyn Lee. This trial is kind of taking the shrouds off the network.

    ........ So the same thing? Every three months? (4weeks x 3). And it has not been testified that Michael had this problem with the B-12. He was healthy and his Lupus was in remission. Even if he did have it, getting B-12 shots every couple of days could cause an overdose (it is possible to overdose on Vitamin B).

    Thome/Phillips - This was PER Michael. You missed the original direct from Chernoff where I posted "Phillips describes Gongaware’s phone call – “dude could you call Dr. Tohme and ask if Michael could do more shows because this is an unprecedented demand”. Phillips was put on the phone with Michael and Michael wanted no more than 50 “he didn’t want to live in London and have to get a new passport”, and find an estate to lease outside of London with stream, horses, 16 acres. That was part of the condition. He didn’t want the kids living in a hotel in the city, not able to get out.".

    Tohme did check with Michael first. That's why Tohme told Randy "No more than 50." Michael CALLED BACK to discuss the conditions on which he would do this.

Phillips is NOT EVEN ALLOWED TO VIEW THE FINDINGS OF THE INSURANCE EXAMS for Michael BY LAW. HIPPA. All he gets to know is that LOL will cover him and that he passed the exam.

    That's like saying Michael should have been held responsible for the Arvizos breaking into his wine cellar and drinking.

    You have allowed that you believe there is a possibility that Michael is alive but you are still trying condemn AEG and Phillips.

    Why? What is your stonewall with AEG?

  21. Hi Bonnie. First It was 3 hours of sleep and then 5 hours of sleep. Chernoff mentioned it too. She asked MJ if he would be able to sleep if she was watching him? He answered, Yes I can. Its no problem. That made me laugh. Wasnt that the problem that he couldnt sleep at all? With or without someone watcing him. MJ gave Lee a hug and left. (His bedroom or his house?) That made me laugh too. Can't be true though. I guess SHE left after the hug. I watched a video were MJ comes out from a shop alone and fans are following him. The fans ask him - Where is your car? MJ says, I don't know and then he giggles. He had to walk around and search for a while before he found it. Susanne

    Is there a video of what Janet said? She seems to be so closed-mouthed, glad to hear she has spoken up!

  23. CPR only leaves bruising on the chest if the person lives. If someone is being administered CPR and they are never revived, it would not leave bruising. You need blood flow in the body to create a bruise.

    By the way... Karen Faye has gone AWOL. It is being reported that the defense cant find her to serve a subpoena. Since that news broke about 20hours ago, she hasnt tweeted since and none of her minions will talk about it.

  24. Bonnie,Hi. Didn't get to see witnesses today,but I did see a clip of LaToya stating that this is all an illusion and we need to read between the lines.
    She also said that we should watch the movie The Illusionist.There are two versions,one with Edward Norton (2006),the other is a French film(2010). They seem to be based on the same story. I haven't seen either of them,but will try to get a look.Peace.Linda

    Did Michael really agree to 50 shows like Randy is saying? If that is so, then why did he say he went to bed thinking it was 10 shows and woke up to finding out it was 50 shows. Then he went on to say something about having to eat more and that he is not a big eater. As much as Randy might have loved Michael, I think he is making sure he goes on record that Michael was a willing participant in adding all those shows. But I am just not so sure of that.

  26. - After the press conference, and after announcement sales were over the top. A pre-registration was done so Michael could build a database of his fans to sell music to directly through Michael Jackson Live.com Phillips said he never saw such a response for tickets. Phillips describes Gongaware’s phone call – “dude could you call Dr. Tohme and ask if Michael could do more shows because this is an unprecedented demand”. Phillips was put on the phone with Michael and Michael wanted no more than 50 “he didn’t want to live in London and have to get a new passport”, and find an estate to lease outside of London with stream, horses, 16 acres. That was part of the condition. He didn’t want the kids living in a hotel in the city, not able to get out.

    Things I found interesting in the above paragraph:

    Michael didn't want to live in London and have to get a new Passport? (Or would that be a Port Pass?) The birth certificate info led me down the rabbit hole so to speak about the freeman and the strawman - a 10 video series by Alex Jones, the Strawman Illusion. Very interesting! If Michael was in the midst of breaking out of the system, he may not have wanted to start a "System" process all over? What would be the difference in living in London vs living in the outlying area and the need for a passport anyway? I've never traveled so I have no idea.

    The other thing that caught my attention was why would Michael specifically say that he wanted Phillips to find an estate to lease outside of London with stream, horses, 16 acres.
    Sounds to me like he already had the place picked out. Any thoughts here? Just trying to READ BETWEEN THE LINES. :D

    All this talk about Red Bull drinks. If Michael was really so health conscious, he'd have stayed away from those drinks. I was thumbing back through Latoya's book where she was talking on the phone with her mother (while Gordon was listing in). Katherine asked if she was okay and Latoya answered back with the question, "What do you mean, am I okay?" Then Katherine asks, "What are you doing?" to which Latoya replies, "Well, I just had a cup of coffee." Katherine says,"Coffee? You drink coffee? What are you doing drinking coffee?" Latoya said that she was not sure why she even mentioned it because she never drank coffee and had only had one sip that day. (Just a tiny bit of contradiction there.)

    Is there something with Jehovah Witnesses that caffeine is to be avoided? If Latoya felt this way, wouldn't it be possible Michael would feel the same? Just supposition. I think they are still trying to show Michael to have addictive qualities, to anything. AND just because Red Bull cans are lying around does not mean that he drinks them - they could belong to security personnel trying to stay awake to "protect" him...

    ....... awwww, this is true and thank you for being so warm. I felt that hug♥ I have an "answer" to a prayer about the truck. It's just old but it was something simple and not the head gasket. Handi-man Ed looked up under the truck with it running (engine, not moving, LOL) and saw what the problem was . . . the oil filter had rusted through (which should never happen if you change it REGUARLY) So he drained it, and he just happened to have a new oil filter and enough oil to replace the drained stuff in one of the packed boxes in the garage (from the old house) Didn't even have to spend any money! (If you don't marry well, marry HANDY! :o) that man can make some BEAUTIFUL furniture. I wish he would do something like that.

    ......... Yes. Orgega didn't tell the whole truth either. You can take that statement two ways and I KNOW WHAT YOU MEAN. I hate when they make statements like that too, but all of it is open to interpretation. I definitely think Randy Phillips knows more than he's telling, but he can't elaborate in court either. Look at all the objections Chernoff got when he tried to ask about the production costs, insurance etc.... Randy answered what he was asked, period. They are not allowed to elaborate. ALL O2 QUESTIONS were off limits. I was like WHAT????

    I know what they're doing - I just wish it wasn't such a struggle for people. It's like having to open our brains back up after being locked up for so long.

    I think I had heard of strawman before but just happened to run onto some information about that recently. And I think of the only production Michael did outside his usual. What part did he play in The Wiz? Scarecrow - straw man!

    Mention of Michael's passport renewal - 50 shows, when was the last show scheduled for...date? Was his passport due to expire shortly after that date?

    ........... I remember that, but I didn't include it because I thought she realized it was five hours when she gave the time and Chernoff said five hours, so he corrected her math.

    Michael coming out of a shop alone? that doesn't sound right. Cute though. Sometimes I can't find my car either and I'm the one that drives it! LOL!

    ......... One of the very good ways to tell someone is lying is that they tend to over-explain things and THAT was one of those times. Plus the woman was way too nervous getting on the stand. She was having an anxiety attack. I've had a few of those in my life, ironically starting after a stalking incident at work.

    There has been a LOT of scheduling issues with witnesses. NOT NORMAL. And I was wrong, it wasn't Janet it was Latoya. The T.V. is behind me so I heard Mitchell say "Janet" but I thought it sounded like Latoya's voice. I wrote what she said down right away and looked it up on the next break. It's on the most recent blog.

    ......... Thank you for the info on the chest bruising you're right, but marks still may have been visible. You just can't tell because the chest on the man in that photo is not the one that belongs to the face in that photo. At least not at the same time.

    Interesting info about Karen Faye. I posted that information on the blog I posted last night but I didn't know who to credit. So anyone who reads this blog and comments will know it was you now. :o) I wonder why she disappeared?

    ... She actually said Edward Norton's name, didn't she? I posted the trailer on last night's blog. I've seen parts of the movie in the past but believe it or not, I think I left the room and was doing something else when it was playing. I think my brother brought it during one of his visits. It may have even been the visit in July of 2009! Interesting story plot . . . and from what a remember, very, VERY intriguing parallel here.

    ........ Hah! Good, everyone heard what Latoya said. I posted it on last night's blog. On Phillips, yes I believe Michael knew it was 50 shows and I believe Phillips when he describes Michael's stipulations for the extended stay in England, demanding the 16 acre estate, horses, stream so the kids will not be locked up, trapped in a hotel all that time.

    What we have heard about Michael's "10 shows to 50 shows" story all came from TINI. Both Latoya and Jermaine have repeated what those stalker fans have said, but NOBODY heard MICHAEL actually say it in person, interviewed. This is all third and fourth hand information. I try to keep that in mind whenever anyone tells me "then why did Michael say this . . ." He DIDN'T say it. THEY SAID that he said it and I don't believe a DOGGONE WORLD any of those fake fans have said. You remember all that from last year, don't you?

    ............ That could VERY WELL be. Passports are not something he ever had to deal with other than sitting for a photo and he probably had alias passports so he wouldn't be mobbed. But what you stated is very conceivable. No doubt Michael knew about the "corporate" individual (Wasn't Michael the "strawman" in "The Whiz"? LOL!)

    ........... Yeah . . . lots, although if we were to take that statement apart, that could in reality be ANYWHERE outside of London. He was only doing two shows a week and in truth I thought the schedule was VERY considerate to Michael. But the 16 acres . . . 16. Hmmmmm. Why sixteen? I'll have to look into that. 16 years from 2009 is 1993. In 1993 Michael was in London (allegedly) undergoing treatment for prescription drug dependency. Who was his traveling doctor at that time? And why after going through treatment was Michael BACK ON IV'S when Jermaine and family paid him a visit of support in Thailand? (Jermaine's book).

    Jehovah's witnesses, I'm not sure, but 7th Day adventists are anti-caffiene people. My sister converted to 7th Day years ago, so that's how I know. Jehovah's Witness and 7th Day both believe the arch angel Michael and Jesus are the same person . . . so they have THAT similarity but I don't know of any others for sure.

  32. When I told you all about the videos concerning the freeman vs strawman illusion I totally spaced the bit of him playing the scarecrow (strawman) in The Wiz! That was one of my 1st thoughts when I was listening to the 1st video. I'm glad you pointed that out Truthbtold2all!

    I really think God has had HIS hand on Michael since he was a baby. Early songs had HIS message even before I'm sure Michael had any say what he and his brothers sang.

    Michael had to be around fifteen. They do a music lesson which goes into a version of "This Old Man". Michael sings,"This old man, he played 5. Full of soul & full of drive" He then scat-sings "Good God",then "He's the baddest man alive". He was BAD before he did the song "Bad". Gotta love it! Devine inspiration for Carol Burnett's writers.
